Article 1: Agreement, Scope, and Acceptance

These Terms and Conditions, together with the Privacy and Data Protection Policy, Responsible Gaming Policy, any game rules, promotion-specific terms, payment instructions, and other policies expressly presented on the Highstack Platform, form the agreement between 3-102-960819 Sociedad de Responsabilidad Limitada, trading as Highstack (the Company, Highstack, we, us, or our), and each person who accesses, registers for, or uses the Platform (the User, you, or your). The Platform includes Highstack.com, its subdomains, mobile or web interfaces, account areas, communications tools, games, sportsbook features where offered, creator and community features, promotional environments, support channels, and any successor service operated under the Highstack brand.

By selecting an acceptance box, registering an Account, connecting a wallet, depositing, wagering, claiming or participating in a promotion, using a creator, referral, reward, or community feature, or otherwise accessing the Platform, you confirm that you have read, understood, and agreed to these Terms. You also confirm that you are legally able to enter into a binding agreement. If you do not agree, you must not create an Account, access the Platform, or use any service made available through it.

Highstack grants access only for personal, private, recreational, and entertainment purposes. The Platform is not offered as an investment service, a savings product, a credit facility, a financial advice service, or a means to generate guaranteed income. No User acquires ownership, proprietary rights, or a transferable interest in the Platform, an Account, a promotion, a reward, a virtual item, a loyalty balance, or any other Platform feature merely by using the Platform.

These Terms apply to every Account and every interaction with the Platform, including interactions through a device, wallet, account credential, referral code, promotional link, customer-support contact, or third-party service connected to Highstack. A User who acts on behalf of another person, allows another person to act through an Account, or uses another person’s identity, device, payment method, wallet, or credentials remains responsible for the resulting activity to the extent permitted by applicable law.

Highstack may change, add, suspend, or remove a service, game, feature, payment route, promotion, jurisdictional availability setting, or technical requirement when reasonably necessary to operate the Platform securely, fairly, and lawfully. Material changes to these Terms will be made available on the Platform. Where a change materially reduces a User’s rights or imposes a material new obligation, Highstack may require renewed acceptance before further use of the affected service. Continued use after the effective date of a published change constitutes acceptance, except where applicable law requires a different process.

Article 2: Definitions and Interpretation

For these Terms, an Account means the personal Highstack account created for and assigned to one verified natural person. An Account includes its credentials, profile, account history, wallets registered or associated with it, balances, rewards, records, security settings, and all activity processed under the Account identifier.

An Associated Account means an Account that Highstack reasonably identifies as connected to another Account through one or more operational, technical, financial, identity, behavioural, or transactional indicators. Association alone does not necessarily establish a breach. It may, however, require a review before Highstack determines whether the Accounts are legitimately independent or form part of a Multiple Account arrangement, shared-account arrangement, fraud pattern, or other prohibited activity.

A Customer Verification Review means an identity, age, address, location, payment-source, wallet-ownership, source-of-funds, source-of-wealth, sanctions, responsible-gaming, fraud-prevention, or related review that Highstack performs to protect the Platform and meet applicable operational requirements.

A Digital Asset means cryptocurrency, stable-value digital asset, token, or other blockchain-based asset that Highstack accepts or displays for a permitted Platform function. A Wallet means an address, account, account abstraction, custody arrangement, or other blockchain-based destination or source used to send or receive a Digital Asset.

A Linked Account means an Account linked to another Highstack service through a permitted single-sign-on or account-linking journey. A Linked Account remains subject to the rules, eligibility criteria, and data practices of the relevant service. Account linking does not permit the transfer of balances, identity, verification status, responsible-gaming restrictions, rewards, or benefits unless Highstack expressly confirms otherwise.

A Multiple Account means any arrangement in which one natural person owns, controls, operates, benefits from, opens, reopens, finances, accesses, or attempts to access more than one Highstack Account, whether directly or indirectly and whether the Accounts use identical or different registration details. A Multiple Account also includes an Account created through or for another person where the actual controller or beneficiary is a person who already has, had, or is prohibited from having an Account.

A Promotion means any optional bonus, reward, incentive, free bet, free spin, credit, rebate, prize, race, competition, referral offer, creator offer, loyalty benefit, STACKz-related benefit, or similar campaign. A Restricted Jurisdiction means a location, country, territory, state, province, or other place from which Highstack does not permit registration, access, participation, or use of a particular service.

A Primary Account means the sole Account that Highstack identifies as the verified Account that a User may retain following an Account Integrity Review. The fact that Highstack permits one Account to remain open does not waive prior or future breaches, nor does it restore benefits that were properly cancelled during a review.

Headings are included for convenience and do not affect interpretation. References to the singular include the plural and references to a person include an individual, where the context permits. Nothing in these Terms limits a right or remedy that cannot lawfully be limited.

Article 3: Eligibility, Location, and Personal Capacity

You may register or use the Platform only if you are at least eighteen years old and have reached any higher legal age of majority or gambling age that applies where you are located, resident, ordinarily resident, or otherwise subject to law. You must not use the Platform if you are underage, lack legal capacity, are acting under coercion, or are acting for a person who is underage or ineligible.

The Platform is not available to residents of Costa Rica. Highstack also restricts registration, access, and participation from the United States and its territories, the United Kingdom, France, Germany, the Netherlands, including Curaçao, Spain, Australia, Austria, Comoros, and any jurisdiction designated by the Financial Action Task Force as a high-risk jurisdiction subject to a call for action. Highstack may add, remove, or vary Restricted Jurisdictions and may restrict particular products, games, promotions, payment routes, or features within a location. The current availability shown on the Platform applies at the time of use.

You are responsible for determining whether you may lawfully access the Platform from your location. Highstack does not make the Platform available as an offer, solicitation, or invitation where access, wagering, receipt of a prize, or use of a Digital Asset would be prohibited. If you are in a Restricted Jurisdiction, you must not attempt to register, log in, wager, deposit, withdraw, claim a reward, or use any feature of the Platform.

You must not use a virtual private network, proxy, remote desktop, location-spoofing tool, device emulator, third-party network, false address, borrowed identity, or any other method intended to conceal, misrepresent, manipulate, or circumvent your actual location or eligibility. You must not ask, permit, induce, or pay another person to access the Platform on your behalf from an eligible location. A breach of this rule is a material breach of these Terms and may lead to immediate protective action.

You participate solely in your own name, for your own personal benefit, and with your own funds and assets. You must not use an Account for a business, corporate, partnership, trust, nominee, agency, or other third-party purpose unless Highstack has expressly approved that use in writing and the arrangement has passed all required reviews. You must not use the Platform to provide services to other gamblers, to pool funds, to operate a syndicate, or to offer any form of account rental, managed gambling, betting advice execution, or intermediary service.

Employees, contractors, officers, directors, consultants, game suppliers, payment providers, affiliate partners, creators, and other persons connected with Highstack may be restricted from specified Platform activities, games, promotions, or markets. A person who is subject to a restriction must not use another person’s Account or create an Account using alternate details to evade it. Highstack may impose further eligibility conditions in promotion, creator, affiliate, or product-specific terms.

Article 4: Registration, Account Creation, and the One-Account Rule

Highstack permits one Account per natural person. This rule applies across active, inactive, suspended, closed, self-excluded, abandoned, incomplete, test, or previously used Accounts. It applies regardless of the email address, telephone number, username, device, browser profile, wallet, payment method, location, referral source, or registration pathway used. A User may not create a second Account because an earlier Account is inaccessible, dormant, closed, limited, under review, self-excluded, ineligible for a promotion, subject to verification, or otherwise inconvenient to use.

During registration, you must provide information that is complete, accurate, current, and uniquely yours. You must not use a false name, an alias intended to conceal identity, a temporary or disposable contact point, a borrowed telephone number, a third party’s address, a shared identity document, altered documentation, a fabricated date of birth, or information that belongs to another person. You must promptly correct information that becomes inaccurate and provide evidence reasonably requested to confirm the correction.

Your registration information must correspond to the information on the government-issued identification, proof of address, payment method, wallet-control evidence, or other supporting materials that Highstack may request. Highstack may refuse an application, decline to complete registration, or restrict an Account when the supplied information is incomplete, inconsistent, duplicative, unverifiable, or linked to a known or suspected prohibited arrangement.

The one-account rule does not prevent Highstack from maintaining internal records needed to administer a closed Account, a self-exclusion, a support case, or a compliance review. It also does not require Highstack to delete an Account record where retention is necessary for legal, security, fraud-prevention, dispute-resolution, or responsible-gaming purposes. A historical Account remains relevant when Highstack assesses whether a new registration is a prohibited duplicate.

An Account is personal, non-transferable, non-saleable, non-assignable, and non-inheritable. You must not buy, sell, lease, share, lend, pledge, gift, exchange, transfer, advertise, broker, or acquire an Account, an Account credential, a verified identity, an account balance, a reward, or access to a promotion. The natural person who originally and validly registered the Account is the person whom Highstack will treat as the Account holder, subject to verification and the applicable evidence.

Highstack may make a limited exception where a User has a documented technical or access issue and Highstack expressly instructs the User to create or use a replacement Account. An exception exists only when Highstack confirms it in writing through an authorised support or compliance channel. It does not arise from an informal communication, an automated message, a creator’s statement, or the fact that a new registration was technically possible.

Article 5: Multiple Accounts, Associated Accounts, and Account Integrity

The one-account rule protects fair play, responsible-gaming controls, identity integrity, promotional fairness, referral integrity, payment integrity, and the security of the Highstack community. You must not create, control, fund, access, or benefit from a Multiple Account. You must not allow another person to create, control, fund, access, or benefit from an Account held in your name. These prohibitions apply whether the conduct is intended to obtain more rewards, evade a restriction, access a promotion again, conceal a source of funds, increase betting or withdrawal capacity, manipulate rankings, avoid verification, bypass a self-exclusion, or produce any other advantage.

A prohibited Multiple Account arrangement includes using different names, nicknames, dates of birth, email addresses, telephone numbers, addresses, wallets, payment instruments, devices, browsers, internet connections, or identity documents to disguise common ownership or control. It also includes using a friend, relative, employee, creator, affiliate, household member, nominee, customer, or other third party as the registered holder where the actual user, controller, funder, beneficiary, or decision-maker is another person.

You must not use more than one Account to claim, multiply, recycle, transfer, convert, or improve access to any Promotion. You must not use Multiple Accounts to receive a welcome offer more than once, obtain repeated cashback, free spins, free bets, credits, referral rewards, creator rewards, loyalty status, STACKz-related benefits, leaderboard positions, race entries, competition entries, giveaways, or any other benefit intended for one eligible person. You must not direct others to create Accounts for the purpose of sharing a benefit, returning funds to you, placing offsetting wagers, or enabling you to retain a benefit that you would not otherwise receive.

You must not create a second Account after requesting a temporary closure, permanent closure, cooling-off period, or self-exclusion. You must not use another person’s Account while you are restricted or excluded. You must not assist an excluded, restricted, underage, or ineligible person to use the Platform. Any attempt to circumvent a protective restriction through a new, associated, shared, or borrowed Account is treated as a serious breach because it undermines the protection requested or imposed for that person.

Accounts can be associated for legitimate reasons. People in the same household may share a residential address, internet connection, device, or family relationship. Different users may use a common network in a workplace, accommodation, or public setting. These facts alone do not automatically prove a breach. However, Highstack may restrict a promotion, delay a transaction, request information, or conduct a review where a shared indicator creates a reasonable account-integrity concern. Users who share a household, device, internet connection, Wallet, payment source, or contact point must not share credentials, funds, identity documents, promotional benefits, referral rewards, or control of Accounts. They must cooperate with a reasonable verification request intended to establish that their Accounts are independently owned and used.

Highstack may identify an Associated Account using information supplied by the User and information generated through legitimate Platform operation, including identity and contact information, verification results, device and browser characteristics, network and geolocation signals, session patterns, payment and Wallet information, blockchain transaction data, referral and promotional activity, game and wagering patterns, customer-support records, and other reliable risk indicators. Highstack does not treat any isolated technical signal as conclusive proof where the surrounding facts reasonably support an innocent explanation. Highstack may nevertheless act promptly where there is a meaningful risk of fraud, abuse, evasion, or harm.

A Wallet may be associated with an Account only if it is owned and controlled by the Account holder and has not been used to fund, receive value from, or otherwise operate another User’s Account except where Highstack expressly permits a verified arrangement. A User may have more than one personal Wallet only if Highstack permits the use and the User can demonstrate ownership and control. A Wallet, payment source, or other financial instrument must not be shared across Accounts in a way that permits account pooling, third-party funding, promotional abuse, evasion of restrictions, or concealment of the source or destination of funds.

If you believe that you created more than one Account by mistake, discover an historic Account, share a household or technical environment with another User, or receive an account-integrity notice that you consider incorrect, you must contact Highstack promptly through the official support process and must not continue to use the potentially affected Accounts while the issue is being assessed. Voluntary disclosure does not guarantee that a benefit will be retained, but it will be considered when Highstack assesses intent, risk, and the appropriate remedy.

Article 6: Account Security, Credentials, and Ownership

You are responsible for maintaining the confidentiality and security of your Account credentials, email account, telephone number, two-factor authentication methods, recovery codes, Wallet credentials, private keys, seed phrases, devices, and payment methods. You must use a strong, unique password where password authentication is available and maintain the security protections that Highstack makes available. You must notify Highstack immediately if you know or reasonably suspect unauthorised access, credential loss, Wallet compromise, device theft, phishing, social engineering, or any other security incident affecting your Account.

You must not disclose your password, recovery code, seed phrase, private key, one-time authentication code, or other security information to another person. Highstack will never legitimately require you to disclose a seed phrase or private key. A person claiming to act for Highstack who requests such information should be treated as suspicious and reported through an official support channel.

You must not permit another person to log in to your Account, use your Account to wager, connect a Wallet, deposit, withdraw, participate in a promotion, communicate with support, or access creator or community features. You are accountable for activity conducted through your Account where it results from your intentional sharing of access or your failure to take reasonable security measures. Highstack may suspend an Account to protect the User, the Platform, or other users while a suspected compromise is investigated.

Highstack may use security checks, transaction confirmations, device verification, multi-factor authentication, step-up verification, login alerts, session limits, and other reasonable safeguards. You agree to complete these measures when requested. A failure to complete a reasonable security check may result in delayed access, restricted functionality, or a temporary Account hold until the risk is resolved.

Account ownership disputes are assessed using the registration record, verified identity evidence, transaction records, Wallet-control evidence, security history, support interactions, and other relevant information. A private agreement between users to transfer an Account or its benefits is not binding on Highstack. Highstack may refuse to disclose information or restore access until it is satisfied that the requester is the verified Account holder.

Article 7: Customer Onboarding, Verification, and Due Diligence

Highstack uses a risk-based approach to customer onboarding and ongoing due diligence. The purpose is to maintain an environment in which users are properly identified, age and eligibility requirements are respected, transactions can be understood, responsible-gaming safeguards can operate, and fraud or misuse can be addressed. You agree to provide information and documents that Highstack reasonably requests for these purposes.

The onboarding process to gather and verify customer information will be activated when the User meets any of the conditions for withdrawal or income amount stipulated by applicable regulation, or earlier where Highstack’s risk assessment, security controls, responsible-gaming measures, payment controls, or operational requirements reasonably require it. Highstack may therefore request verification before registration is completed, before a deposit or withdrawal is processed, before a promotional benefit is released, after a change in account details, or at any later time during the relationship.

Verification may include proof of identity, age, address, residential location, telephone number, email address, Wallet ownership or control, payment-source ownership, source of funds, source of wealth, occupation, purpose of the relationship, and any other information reasonably necessary to resolve a risk concern. Highstack may ask for a live image, video verification, additional documents, an explanation of a transaction pattern, or evidence that a particular Wallet or payment method is under the User’s own control. Documents must be genuine, current, readable, complete, and unaltered.

Highstack may conduct electronic, database, sanctions, politically exposed person, adverse-media, fraud-prevention, blockchain-analytics, payment-risk, and other verification checks through appropriate service providers. Highstack may compare information across Accounts, Wallets, payments, devices, referrals, promotions, and support records where permitted by applicable data-protection rules and where reasonably necessary to prevent duplication, fraud, misuse, or evasion.

Users assessed as presenting a higher risk may be subject to enhanced due diligence. Enhanced due diligence may include additional identity checks, closer review of linked persons or Wallets, evidence of source of wealth, more frequent review, enhanced monitoring, payment or withdrawal restrictions, or a decision not to establish or continue the relationship. Highstack is not obliged to disclose the detailed nature, thresholds, methodology, or outcome of a fraud, compliance, sanctions, or suspicious-activity assessment where disclosure could compromise an investigation, security measure, legal obligation, or third-party right.

You must respond truthfully, promptly, and completely to a verification request. If you decline, delay, obstruct, mislead, submit altered or third-party material, or otherwise prevent Highstack from completing a review to its reasonable satisfaction, Highstack may limit deposits, wagers, promotions, transfers, withdrawals, or account access; suspend or close the Account; cancel ineligible benefits; or take any other action permitted by these Terms and applicable law. Highstack may retain or report information where required or permitted for security, legal, fraud-prevention, or compliance purposes.

Article 8: Deposits, Withdrawals, Digital Assets, and Payment Integrity

Highstack accepts only payment methods, Digital Assets, Wallets, and transaction routes that it makes available on the Platform. Availability may vary by product, User, location, and risk profile. Highstack does not provide credit, loans, guarantees, investment services, exchange services for speculative purposes, financial advice, tax advice, or legal advice. You must not treat an Account balance as a bank deposit, savings account, custody product outside the Platform’s stated service, or investment.

All funds, Wallets, payment methods, and financial instruments used in connection with an Account must be owned and controlled by the verified Account holder. Third-party deposits, third-party withdrawals, third-party Wallets, shared financial instruments, anonymous funding routes, corporate funding without written approval, and transfers designed to obscure ownership or source of funds are prohibited. Highstack may require a withdrawal to be returned to a verified original source, a Wallet demonstrably controlled by the User, or another destination that Highstack permits after verification.

You are solely responsible for selecting the correct Wallet address, supported network, asset, and transaction parameters. Blockchain transactions may be irreversible. Highstack does not guarantee recovery of Digital Assets sent to an incorrect, unsupported, incompatible, or inaccessible address or network. Any attempted recovery is discretionary, dependent on technical feasibility and security considerations, and may involve reasonable costs or a decision that recovery cannot be attempted.

Digital Asset values can fluctuate rapidly. Network congestion, fees, validator activity, chain reorganisation, service outages, smart-contract failures, third-party Wallet failures, and other events may delay, reduce, prevent, or affect the visibility or completion of a transaction. Highstack is not responsible for a loss caused by a User’s choice of asset, Wallet, network, fee, timing, or third-party provider, except to the extent that liability cannot lawfully be excluded.

Highstack may impose, revise, delay, limit, or refuse deposits, withdrawals, conversions, and payment routes in accordance with applicable regulations, payment-provider requirements, security measures, verification outcomes, responsible-gaming protections, risk assessments, and operational capacity. Highstack will always comply with limits required by applicable regulations. A displayed balance, pending transaction, or initial confirmation does not create an unconditional right to withdrawal where a verification, security, error-correction, fraud-prevention, responsible-gaming, or account-integrity review remains outstanding.

A deposit, payment, wager, or withdrawal may be placed on hold while Highstack reviews identity, Wallet ownership, source of funds, source of wealth, account association, restricted-location access, promotional eligibility, suspicious activity, technical error, or another legitimate concern. Highstack will process undisputed and permissible funds in accordance with applicable law once the relevant review is completed. Where a breach, fraud, error, or prohibited activity is established, Highstack may take the corrective measures described in these Terms.

Article 9: Games, Wagers, Settlements, and Technical Errors

You may participate in a game, wager, or product only where it is displayed as available to you and you have a sufficient cleared balance. You must read the rules of each game, product, promotion, tournament, competition, or sportsbook market before participating. Product-specific rules, including game-provider rules and sportsbook rules where offered, apply to the relevant activity. If a product-specific rule conflicts with these Terms, the product-specific rule prevails only to the extent of that conflict.

All wagers are subject to acceptance by the relevant Highstack system and, where applicable, the relevant provider system. A wager is not accepted merely because it was attempted, displayed in a browser, transmitted from a device, or reflected in a pending interface. Highstack’s transaction, game, and provider records, maintained in the ordinary course of business, are the authoritative record of acceptance, stake, odds, gameplay, settlement, and balance movements unless there is clear evidence of a material error in those records.

Highstack may correct an obvious error, misprint, technical malfunction, game malfunction, incorrect odds, incorrect price, incorrect payout, display issue, settlement error, duplicate transaction, unauthorised transaction, or other material mistake. Highstack may void an affected wager, game round, transaction, competition entry, reward, or balance adjustment where the error materially affected the outcome. Where reasonably practicable and lawful, Highstack will restore the User to the position that would have applied absent the error. A malfunction voids affected play where the malfunction prevented reliable settlement.

You must not exploit, continue to exploit, conceal, disseminate, or coordinate around an error, vulnerability, delay, stale feed, latency issue, misconfiguration, unintended game state, bonus defect, referral defect, or other weakness. If you identify a suspected vulnerability or abnormal result, you must stop using the affected feature and report it promptly through official support. Highstack may investigate, suspend the relevant feature, correct account balances, recover improperly credited value, and take further action where misuse occurred.

Highstack may suspend a market, game, provider, tournament, competition, or promotional event where integrity, data, availability, legal compliance, or security is affected. For sportsbook activity where offered, Highstack may withhold settlement or void an affected wager where there is credible evidence of event manipulation, market manipulation, automated betting, corrupted or delayed data, use of inside information, betting after a material event, coordinated syndicate activity, or another integrity concern. Settlement will be completed or corrected when the relevant facts can be reliably determined.

Article 10: Promotions, Referrals, Rewards, Creator Features, and STACKz

Promotions are optional, conditional, personal, non-transferable, and may be changed, suspended, withdrawn, withheld, or cancelled where permitted by applicable law. A Promotion is available only to a User whom Highstack determines to be eligible under these Terms and the applicable promotion-specific rules. Highstack may require opt-in, verification, a minimum activity level, a specified payment route, a location check, or another condition shown in the relevant promotion communication.

Unless a promotion expressly states otherwise, each Promotion is limited to one eligible person and one verified Account. Highstack may limit a Promotion to one household, residence, device, network, Wallet, payment method, payment source, family group, business, creator community, referral relationship, or other objectively connected group where this is necessary to protect the integrity of the campaign. A shared device, network, or address does not itself establish wrongdoing, but it may make a User ineligible for a promotion or require a review before a benefit is granted.

You must not engage in bonus abuse, promotion arbitrage, low-risk or offset wagering intended principally to convert promotional value, deceptive wagering patterns, repeated account registration, repeated closure and reopening, reward farming, split funding, Account rotation, manipulation of game mechanics, manipulation of rankings, manipulation of creator metrics, or any conduct designed to obtain a benefit without the genuine activity or risk that the Promotion contemplates. Highstack may withhold, deny, reduce, reverse, cancel, or recover a reward, benefit, prize, bonus, credit, STACKz-related entitlement, loyalty status, referral payment, or other promotional value that was obtained or used in breach of these Terms or the applicable promotion rules.

Referral and creator features may be used only to introduce genuine, independent Users. You must not refer yourself, refer an Associated Account, arrange circular referrals, pay or promise a person to register for the purpose of generating a referral benefit, use misleading promotion methods, create fictitious communities, or direct an ineligible person to register. You must not use a creator, affiliate, or referral relationship to conceal common control of Accounts, transfer benefits, place wagers on another person’s behalf, or avoid a restriction. Highstack may reverse or withhold rewards and terminate participation in a referral or creator programme where it reasonably identifies abuse or non-compliance.

STACKz, loyalty points, status indicators, virtual credits, non-cash rewards, and similar benefits are Platform features, not money, a bank balance, a Digital Asset, a security, property, or a guarantee of future value. They may be subject to availability, expiry, modification, eligibility requirements, and specific rules displayed on the Platform. They may not be sold, bought, assigned, pooled, pledged, transferred, exchanged, or redeemed except where Highstack expressly offers a permitted function. Highstack may correct, remove, or adjust them where they were granted in error, obtained through a Multiple Account, obtained through promotion abuse, or otherwise improperly credited.

Highstack may publish rules for competitions, races, giveaways, challenges, leaderboards, and creator events. Such rules may set participant caps, eligibility conditions, prohibited conduct, settlement logic, prize conditions, and cancellation rights. A User who manipulates entries, uses Multiple Accounts, coordinates with others to distort a result, transfers eligibility, or uses an ineligible Wallet or identity may be removed from the event and may lose any related benefit, subject to Highstack’s review and applicable law.

Article 11: Prohibited Conduct, Fraud, Collusion, and Unfair Advantage

You must use the Platform honestly and fairly. You must not engage in fraud, attempted fraud, deception, collusion, cheating, account takeover, identity theft, payment abuse, money laundering, terrorist financing, sanctions evasion, bribery, match manipulation, game manipulation, or any unlawful activity. You must not use the Platform to facilitate an illegal transfer of value, conceal the origin or destination of funds, or process activity that is not genuinely your own.

You must not access, interfere with, damage, disrupt, scrape, probe, test, overload, or circumvent the Platform, its servers, networks, databases, security measures, game systems, Wallet infrastructure, interfaces, application programming interfaces, or provider systems. You must not use password mining, phishing, malware, viruses, worms, bots, scripts, macros, automation, artificial traffic, denial-of-service techniques, reverse engineering, decompilation, disassembly, code extraction, data harvesting, unauthorised API use, or any tool intended to obtain an unfair advantage or information not publicly available through ordinary authorised use.

You must not use automated software, artificial intelligence agents, scripts, hardware devices, multi-account management tools, remote-control services, betting software, betting syndicates, or any other system designed to automate, optimise, duplicate, coordinate, or disguise activity unless Highstack has expressly approved the specific use in writing. You must not use bots to register Accounts, collect promotions, claim rewards, place wagers, participate in a competition, interact with support, or manipulate any creator or community metric.

You must not collude with another User or third party. Prohibited collusion includes sharing strategy or non-public information to distort a game or market, coordinated wagering, opposite betting, chip dumping, account pooling, use of a common fund, pre-arranged trading of benefits, price manipulation, coordinated referrals, coordinated reward claims, shared Wallet use, and any arrangement that reduces genuine risk or creates an unfair advantage. Highstack may assess conduct across Accounts, products, Wallets, providers, and time periods when determining whether activity was coordinated.

You must not submit false, altered, stolen, expired, incomplete, misleading, or third-party identity, address, payment, Wallet, source-of-funds, source-of-wealth, or eligibility documentation. You must not encourage, procure, or assist another person to submit such material. You must not disclose another person’s documentation to Highstack without a lawful basis and appropriate authority.

You must not harass, threaten, abuse, deceive, defame, discriminate against, impersonate, stalk, exploit, or unlawfully target another User, Highstack personnel, a provider, creator, affiliate, or third party. Live chat, community, and support features must not be used for illegal conduct, spam, scams, solicitation, unauthorised advertising, malicious code distribution, grooming, hate speech, sexually explicit content, threats, doxxing, or content that infringes another person’s rights. Highstack may moderate, remove, retain, or report content and restrict access to interactive features where reasonably necessary.

Article 12: Responsible Gaming, Account Closures, and Protective Restrictions

Highstack supports responsible use of the Platform. Gambling can cause financial, emotional, and social harm. You should use the Platform only for entertainment, within your means, and only when you are able to make a free and informed decision to participate. You must not use the Platform while underage, impaired, distressed, subject to a legal restriction, or unable to control your gambling activity.

Highstack may provide responsible-gaming tools and may apply protective measures where it identifies concerning activity or where a User requests assistance. These measures may include deposit, loss, wagering, time, session, or access restrictions; a cooling-off period; a temporary closure; a permanent closure; a self-exclusion; a welfare interaction; a restriction on promotions; or a requirement for further information. Available tools and their operation are described in the Responsible Gaming Policy and the relevant Platform interface.

A User who requests or is subject to a temporary closure, cooling-off period, permanent closure, or self-exclusion must not register, access, fund, wager through, or benefit from another Account during the restriction. This includes an Account held by a family member, household member, friend, associate, creator, affiliate, or nominee. The User must not attempt to remove, shorten, or evade a restriction through a different email address, Wallet, device, payment method, location, identity detail, or third party.

Highstack may use reasonable account-association controls to identify attempted circumvention of a responsible-gaming restriction. Where Highstack reasonably identifies a connection to an excluded or restricted person, it may close or limit an Account, suspend a withdrawal, cancel promotional benefits, prevent further deposits or wagers, and require verification. A User who knowingly circumvents a protective restriction may not claim compensation for activity undertaken through the circumvention, subject always to applicable law and the facts of the individual case.

A User may request ordinary Account closure through the support process. Highstack may distinguish between an ordinary closure, a temporary closure, a cooling-off period, and self-exclusion. A User must accurately state the reason for a closure request. A request indicating harm, loss of control, financial distress, or a desire to stop gambling may be treated as a responsible-gaming request rather than an ordinary administrative closure where doing so is reasonably necessary to protect the User.

Highstack may refuse to reopen an Account or may require further verification, a waiting period, and a responsible-gaming assessment before reopening a temporarily closed Account. A permanently closed or self-excluded Account may not be reopened except where applicable rules expressly permit a lawful and safe process. The creation of a replacement Account does not override a closure or exclusion.

Article 13: Monitoring, Investigations, and Account Integrity Reviews

Highstack may monitor Accounts, transactions, Wallets, deposits, withdrawals, gameplay, wagers, promotions, referrals, creator activity, device and network signals, geolocation, communications, and other Platform activity to maintain security, integrity, fair play, responsible-gaming protections, and compliance with these Terms. Monitoring may be automated, manual, or a combination of both. Highstack may use reasonable internal and third-party tools to identify unusual, risky, duplicate, fraudulent, abusive, or prohibited activity.

An Account Integrity Review may be triggered by a potential Multiple Account, shared control, third-party funding, inconsistent identity data, a location anomaly, a Wallet association, a payment mismatch, a promotion or referral pattern, a self-exclusion match, an unusual wagering pattern, an external security alert, or another legitimate concern. Highstack may begin a review before informing the User where immediate notice could compromise evidence, a security measure, a responsible-gaming safeguard, a legal requirement, or another person’s privacy.

During a review, Highstack may place a temporary restriction on registration, login, deposits, wagering, promotions, referrals, reward claims, transfers, withdrawals, or other Account functions. Highstack may request explanations, documents, transaction records, Wallet-control evidence, proof of address, or other information reasonably needed to resolve the concern. A restriction is not a conclusion that a breach occurred. It is a protective measure that may remain in place for as long as reasonably necessary to complete the review.

Highstack may combine or compare records relating to Associated Accounts for the limited purposes of assessing common control, repeated benefit claims, security incidents, fraud, financial crime risk, responsible-gaming circumvention, or another breach. Highstack will handle personal information in accordance with the Privacy and Data Protection Policy and applicable data-protection requirements. Highstack will not disclose one User’s personal information to another User merely because the Accounts are associated or because a User disputes the association.

You must cooperate in good faith with an Account Integrity Review. You must preserve relevant evidence, answer truthfully, avoid deleting or altering material requested by Highstack, and refrain from opening or using another Account while the matter is being reviewed. You must not contact another User to coordinate a response, fabricate an explanation, obtain false documents, or pressure a third party to intervene.

Highstack may make decisions on the available evidence. Where the evidence is incomplete because a User has not cooperated, Highstack may reasonably draw conclusions from the records available to it. Highstack will consider credible information supplied by the User, including evidence of separate identity, separate control, separate funding, separate Wallet ownership, or a legitimate shared-household arrangement. Highstack may revisit a decision if material new evidence is provided through the official appeal route.

Article 14: Suspension, Closure, Remedies, and Treatment of Funds

Highstack may refuse registration, restrict a feature, suspend an Account, close an Account, decline a transaction, cancel a Promotion, remove a reward, void an affected wager or game activity, recover improperly credited value, or take another proportionate protective action where Highstack reasonably believes that a User has breached these Terms, is likely to cause harm, cannot be verified, has used a Multiple Account, has circumvented a responsible-gaming restriction, has engaged in fraud or abuse, has accessed from a Restricted Jurisdiction, has used third-party funds, has submitted misleading information, has violated a game or promotion rule, or presents a material security, legal, financial-crime, or integrity risk.

Where a Multiple Account is established or reasonably confirmed, Highstack may designate one verified Primary Account or may close all affected Accounts, depending on the facts, the User’s cooperation, the risk, the nature of the breach, and applicable law. Highstack is not required to consolidate Accounts, preserve a preferred username, preserve a promotional status, transfer benefits, or treat a duplicate registration as valid merely because the User later identifies it as accidental.

Highstack may cancel, reverse, remove, recover, or decline to award promotional value, referral value, creator benefits, loyalty rewards, STACKz-related benefits, free bets, free spins, credits, prizes, rebates, and winnings attributable to a Multiple Account, prohibited association, false eligibility statement, bonus abuse, fraud, collusion, technical exploit, or other breach. Highstack may offset properly recoverable amounts against an available Account balance where permitted by applicable law.

Highstack will assess the treatment of deposited funds and legitimately settled value case by case, taking account of the nature of the breach, the provenance of the funds, verification results, the need to prevent unjust enrichment, security concerns, responsible-gaming protections, applicable law, and any obligation to freeze, retain, return, report, or transfer value. Highstack may delay or withhold a payment while a review is ongoing or where payment would be unlawful, unsafe, fraudulent, or contrary to these Terms. Nothing in these Terms requires Highstack to pay value arising from a void transaction, an ineligible Promotion, a fraudulent activity, a prohibited Multiple Account, or a material error.

Where Highstack closes an Account for an ordinary administrative reason and no restriction, fraud concern, verification issue, or legal impediment applies, Highstack will make reasonable efforts to facilitate withdrawal of a permissible remaining balance through a verified route. Highstack may require the Account holder to complete verification before releasing any funds. Network fees, payment-provider fees, and other disclosed charges may apply.

Highstack may retain records and, where required or permitted, disclose information to competent authorities, financial institutions, payment providers, game suppliers, fraud-prevention providers, blockchain-analytics providers, and other appropriate parties. Highstack may make a report or disclosure without informing the User where notice would compromise an investigation, violate a legal obligation, or create a safety or security risk.

An Account with no login activity for a continuous period of six years may be classified as dormant. Highstack may take steps concerning a dormant balance in accordance with applicable law after making reasonable efforts to contact the Account holder where appropriate. Highstack may treat a dormant Account as relevant when applying the one-account rule.

Article 15: Communications, Support, Complaints, and Account-Integrity Appeals

Highstack may communicate with you through the registered email address, in-Platform messages, the Account area, SMS or telephone where you have provided the relevant contact detail and consent or another lawful basis exists, or another official channel displayed on the Platform. You are responsible for keeping your contact details current and for monitoring communications relating to security, verification, responsible gaming, transaction status, policy changes, and Account restrictions.

Customer support is available through the official support route made available on the Platform. Support communications must be respectful, truthful, and limited to legitimate purposes. Highstack may record, retain, and review calls, chats, emails, tickets, and other communications where permitted by applicable law for quality assurance, security, training, dispute resolution, fraud prevention, and enforcement of these Terms.

A User who wishes to complain must submit the complaint through the official support route using the registered Account email address where possible. The complaint should identify the User, the relevant Account, the material facts, the transaction or event at issue, the date and time where known, and the outcome sought. Highstack may require information sufficient to verify the User’s identity before discussing Account-specific information.

A User may request a review of a Multiple Account, Associated Account, account-closure, withdrawal-hold, promotion, or account-integrity decision. The request must be made promptly after notification and must include any evidence that the User considers material. Examples may include proof of distinct identity, distinct residence, independent device control, separate Wallet ownership, separate funding, or a legitimate explanation for a shared technical signal. Highstack may not disclose information about another person, Account, or detection method when responding to an appeal.

Highstack will review an appeal in good faith using the available evidence and may uphold, amend, or reverse the original decision. Highstack may request additional information or an interview before deciding. A decision remains effective while an appeal is being assessed unless Highstack expressly confirms otherwise. The internal appeal route does not prevent either party from exercising rights that cannot lawfully be limited, but it is intended to give Highstack an opportunity to resolve the matter before formal proceedings are commenced.

Article 16: Privacy, Data Use, Records, and Confidentiality

Highstack processes personal information in accordance with the Privacy and Data Protection Policy and applicable data-protection requirements. By using the Platform, you acknowledge that Highstack may collect, use, retain, analyse, and share personal and technical information where this is necessary to provide the Platform, verify identity and eligibility, protect Accounts, prevent Multiple Accounts, detect fraud and financial crime, operate responsible-gaming protections, process transactions, resolve disputes, enforce these Terms, and meet legal or operational requirements.

The information Highstack may process includes registration data, identity documents, contact details, device and browser data, network and geolocation information, session data, transaction data, Wallet addresses and blockchain transaction information, payment information, game and wagering records, promotion and referral activity, support communications, responsible-gaming records, verification results, and risk indicators. Highstack may use service providers to process data on its behalf under appropriate contractual and security controls.

Highstack may create and retain an account-integrity record where it reasonably identifies or investigates Multiple Accounts, false identity information, restricted-jurisdiction access, self-exclusion circumvention, fraud, promotion abuse, security compromise, or other prohibited conduct. Such a record may be used to prevent the creation or reopening of an Account, to apply a responsible-gaming restriction, to protect other users, or to respond to a legal or regulatory obligation. Highstack will not use an account-integrity record beyond the purposes and retention periods permitted by applicable law.

Users must not disclose another person’s personal information, Account information, Wallet information, verification materials, or support communications without a lawful basis. You must not publish, sell, trade, or misuse information obtained through the Platform. Highstack may restrict or close an Account where a User unlawfully discloses confidential or personal information or attempts to interfere with another User’s privacy or Account security.

Article 17: Intellectual Property, Content, and Third-Party Services

The Platform, its software, interfaces, text, artwork, graphics, audiovisual material, trademarks, trade names, logos, game content, data, databases, designs, code, features, and other materials are owned by or licensed to Highstack or the relevant rights holder. They are protected by applicable intellectual-property laws. Highstack grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Platform solely for lawful personal use in accordance with these Terms.

You must not copy, reproduce, adapt, modify, distribute, publish, display, perform, sell, license, rent, lease, translate, create derivative works from, scrape, extract, frame, mirror, reverse engineer, or otherwise exploit any Platform content except where Highstack expressly permits it in writing or where a non-excludable legal right applies. You must not remove or obscure a copyright, trademark, or proprietary notice.

Games, payments, Wallet tools, identity-verification tools, community tools, communications services, and other Platform features may be provided by independent third parties. The relevant provider may apply its own rules, technical limits, availability restrictions, privacy notices, and settlement procedures. Highstack may rely on the records and results supplied by a provider where reasonably appropriate. Highstack is not responsible for a third-party website, Wallet, application, social-media service, or service provider that is not operated by Highstack, except to the extent that responsibility cannot lawfully be excluded.

If you submit content through a permitted Platform feature, you represent that you have the right to submit it and that it does not violate law or another person’s rights. You grant Highstack a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, adapt, moderate, and use that content as reasonably necessary to operate, promote, secure, and improve the relevant feature, subject to applicable law and the Privacy and Data Protection Policy. Highstack may remove content that breaches these Terms or creates a legal, safety, security, or reputational risk.

Article 18: Availability, Disclaimers, and Limitation of Liability

The Platform is provided on an “as available” and “as is” basis, subject to any warranties or consumer protections that cannot lawfully be excluded. Highstack does not promise uninterrupted, secure, error-free, or continuously available access. Highstack may experience or be affected by maintenance, network interruption, Digital Asset network conditions, provider disruption, data-feed failure, cyberattack, force majeure, legal change, system failure, or another event beyond its reasonable control.

Highstack does not guarantee that a game, product, promotion, feature, reward, Digital Asset, payment route, Wallet integration, creator feature, or service will be available at a particular time, in a particular location, or for a particular User. Highstack may suspend access, remove content, restrict a product, or change a technical feature where reasonably necessary. Highstack will use reasonable efforts to restore material services after a temporary disruption where restoration is practicable.

To the fullest extent permitted by applicable law, Highstack and its affiliates, directors, officers, employees, contractors, licensors, providers, and agents are not liable for indirect, consequential, incidental, special, exemplary, punitive, or purely economic loss, including loss of profit, loss of opportunity, loss of goodwill, loss of data, loss caused by market movements, or loss arising from a User’s failure to secure credentials, Wallets, devices, or payment methods. This limitation does not apply where liability cannot lawfully be excluded or limited.

Nothing in these Terms excludes or limits liability for fraud by Highstack, intentional misconduct, death or personal injury caused by negligence where such exclusion is prohibited, or any other liability that applicable law does not permit Highstack to exclude or limit. Where a limitation of liability is unenforceable in a particular jurisdiction, it applies only to the maximum extent permitted in that jurisdiction.

Article 19: Indemnity and User Responsibility

To the fullest extent permitted by applicable law, you will indemnify and hold harmless Highstack and its affiliates, directors, officers, employees, contractors, licensors, suppliers, and agents from losses, liabilities, claims, reasonable costs, and expenses arising directly from your material breach of these Terms, fraudulent or unlawful conduct, misuse of the Platform, infringement of a third party’s rights, or unauthorised use of another person’s Account, identity, Wallet, payment method, or personal information.

This indemnity does not require you to indemnify Highstack for loss caused by Highstack’s own fraud, intentional misconduct, gross negligence where non-excludable, or a liability that cannot lawfully be transferred. Highstack may take control of the defence of a claim for which it seeks indemnity, and you must reasonably cooperate, provided that Highstack does not settle a claim in a manner that imposes a non-monetary obligation on you without your consent.

You are responsible for complying with the tax, reporting, exchange-control, and other obligations that apply to your use of the Platform, Digital Assets, winnings, rewards, or transactions. Highstack does not provide tax or legal advice. You should obtain independent professional advice where appropriate.

Article 20: Governing Law, Jurisdiction, and Dispute Resolution

These Terms and any non-contractual obligation arising out of or connected with them are governed by the laws of Costa Rica, without regard to conflict-of-law principles that would require the application of another law. This choice does not deprive a User of mandatory protections that apply and cannot lawfully be excluded.

Before commencing formal proceedings, a User should submit the concern through Highstack’s official complaints process and allow Highstack a reasonable opportunity to investigate and respond. The parties may attempt in good faith to resolve the issue informally. Nothing in this process requires a User to waive a right that cannot lawfully be waived or prevents Highstack from taking immediate protective action to secure the Platform, preserve evidence, comply with law, or prevent harm.

Subject to mandatory law, the competent courts of Costa Rica have exclusive jurisdiction over any dispute, controversy, claim, or proceeding arising out of or relating to these Terms, the Account, the Platform, a transaction, a promotion, or the relationship between Highstack and the User. You and Highstack submit to the jurisdiction of those courts.

Article 21: Future Availability and Adaptation

Highstack may seek to make services available in additional regulated or permitted markets in the future. Availability in any location depends on the operational conditions, product rules, technical controls, and legal requirements that apply at the relevant time. Highstack may introduce market-specific terms, identity requirements, payment conditions, tax information, responsible-gaming measures, language versions, consumer disclosures, or dispute procedures where necessary.

If a market-specific term conflicts with these Terms, the market-specific term applies only to the relevant User, location, or product and only to the extent of the conflict. Highstack may require a User to accept an updated or localised agreement before using a newly available service. A User must not attempt to access a market-specific feature before Highstack has made it available to that User.

Article 22: General Provisions

These Terms, the Privacy and Data Protection Policy, the Responsible Gaming Policy, product-specific rules, and promotion-specific terms constitute the entire agreement between you and Highstack concerning use of the Platform. They replace earlier discussions, representations, understandings, and agreements on the same subject matter, except in the case of fraud or where a separate written agreement expressly states that it prevails.

If a provision of these Terms is found invalid, illegal, or unenforceable, that provision will be applied to the maximum extent permitted or severed to the minimum extent necessary. The remaining provisions will continue in full force. A failure or delay by Highstack to enforce a right does not waive that right. A waiver is effective only if made in writing by an authorised Highstack representative.

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms. Highstack may assign, transfer, subcontract, or delegate its rights and obligations where permitted by applicable law, including as part of a merger, acquisition, restructuring, financing, or transfer of business assets. Highstack will provide any notice required by applicable law.

No partnership, agency, fiduciary relationship, joint venture, employment relationship, or authority to bind Highstack is created between you and Highstack by these Terms. You may not represent that you act for or on behalf of Highstack unless Highstack has expressly authorised you in writing.

These Terms may be made available in more than one language for convenience. The English version controls to the extent permitted by applicable law. If a translation materially differs from the English version, Highstack may correct the translation and will not rely on the difference to deprive a User of a mandatory legal protection.

Appendix A: Multiple-Account Enforcement Principles

This Appendix forms part of the Terms and explains how Highstack applies the one-account rule. Highstack’s objective is to prevent duplicated access, identity misuse, promotional abuse, responsible-gaming circumvention, third-party funding, collusion, and other activity that undermines fair participation. The objective is not to penalise legitimate users merely because they share an address, connection, or device with another independent user.

When Highstack identifies a potential association, it may first apply a narrow, proportionate control, such as restricting a promotion, pausing a withdrawal, requesting verification, or preventing a new Account from completing registration. The appropriate control depends on the risk. Highstack may act more urgently when the evidence suggests identity fraud, self-exclusion circumvention, underage access, restricted-jurisdiction access, third-party control, fraudulent funding, or a live attempt to exploit a Promotion.

A User has the opportunity to explain a genuine shared-household or shared-technical circumstance through the official support route. Highstack may request information that reasonably distinguishes independent users from a common controller. Highstack will not require a User to disclose another person’s password, private key, seed phrase, or other security credential. Highstack may instead request independent verification, proof of residence, proof of Wallet control, payment-source evidence, or a clear explanation of the connection.

When a breach is confirmed, Highstack may select a remedy that is proportionate to the breach and protects the Platform. A deliberate pattern of concealed Multiple Accounts, self-exclusion evasion, false documentation, third-party funding, promotional exploitation, or fraud may justify closure and the cancellation or recovery of improperly obtained value. An accidental duplicate, promptly self-reported and not used to obtain an advantage, may be handled by closing or consolidating the duplicate and requiring verification. Highstack is not required to treat every incident identically because relevant facts, risk, legal obligations, and user conduct may differ.

The following summary is an operational guide and does not limit Highstack’s rights under the Terms or applicable law.

Account integrity
Where an account-integrity concern arises, Highstack may take the following protective action.

- Accidental duplicate reported before use. Highstack may verify identity, close or merge the duplicate where technically possible, retain one verified Primary Account, and preserve only legitimate non-promotional activity.
- Shared household, device, or network. Highstack may restrict promotion access temporarily, request evidence of independent ownership and funding, and maintain separate Accounts only if the arrangement is satisfactorily verified.
- Shared Wallet, payment method, or funding source. Highstack may pause transactions, request Wallet-control and payment-source evidence, prevent cross-account funding, and restrict or close Accounts if third-party funding or common control is established.
- Repeated promotion, referral, reward, or STACKz claim. Highstack may cancel or recover ineligible promotional value, void associated eligibility, review connected Accounts, and restrict future promotional participation.
- Use of another person's identity or documents. Highstack may suspend or close Accounts, preserve evidence, decline transactions, and make disclosures where required or permitted.
- Circumvention of a closure or self-exclusion. Highstack may immediately restrict the Account, apply responsible-gaming safeguards, cancel ineligible benefits, and take any further action necessary to prevent continued access.
- Deliberate fraud, collusion, or technical exploitation. Highstack may suspend or close affected Accounts, void affected activity, recover improperly credited value where permitted, preserve records, and report or disclose information where required or appropriate
